James and Tincu to wait on verdict

Both Paul James and Marius Tincu will have to wait until November 4 to learn their fates after their hearings for Heineken Cup citings were adjourned on Thursday.
James, of the Ospreys, and Tincu, of Perpignan, had both been cited for different offences, but both are alleged to have occurred during the same incident.
The citings arose from the Round 2 Heineken Cup Pool 3 match between the Ospreys and Perpignan at the Liberty Stadium on Saturday, 18 October, 2008 and were lodged by the Citing Commissioner for the match, Douglas Hunter (Scotland).
The citing against Marius Tincu is for alleged contact with the eye / eye area of Ospreys player Paul James in contravention of Law 10.4 (k).
The citing against Paul James for is for an alleged strike with the arm on Perpignan player Marius Tincu in contravention of Law 10.4 (a).
The independent Disciplinary Committee, which was chaired by HHJ Jeff Blackett (England) and also comprised Dr Barry O'Driscoll (Ireland) and Mr Robert Horner (England), adjourned the hearing to allow Marius Tincu to attend the hearing in person and for the collection of additional evidence.
Meanwhile the case against Perpignan's Guilhem Guirado was dismissed.

The citing lodged by the Citing Commissioner for the match, Douglas Hunter (Scotland), was for alleged contact with the eye / eye area of Ospreys player Ian Gough (No 18) in contravention of Law 10.4 (k).
The independent Disciplinary Committee was chaired by HHJ Jeff Blackett (England) and also comprised Dr Barry O'Driscoll (Ireland) and Mr Robert Horner (England).
After considering the evidence available, the independent Disciplinary Committee found that there was insufficient evidence to show Mr Guirado had been guilty of foul play and accordingly dismissed the citing.
Both parties have the right to appeal
